Relief Options for Foreign Nationals Facing a Deportation Order After an Unlicensed Driving Case

Hello. This is Law Firm Majung.   For foreign nationals living in Korea, being caught driving without a valid driver’s license often does not end as a simple traffic violation.   This is because a police investigation typically follows the incident, and the investigation results may be forwarded to the immigration authorities, where even a deportation order (departure order) can be reviewed.   In today’s post, we will explain practical ways to seek relief and respond effectively after being caught driving without a license as a foreign national.

1. Why Does Driving Without a License as a Foreigner in Korea Become a Bigger Issue?

Being caught driving without a license as a foreign national is not simply a matter of “not having a driver’s license.”   In Korea, driving without a valid license is subject to criminal punishment, and for foreign nationals, this fact can immediately lead to administrative action by immigration authorities.   In particular, the scope of the issue may expand further in situations such as the following:
  • Using a foreign driver’s license that is not valid for use in Korea
  • Driving after the license renewal period has expired
  • Driving without insurance coverage
  • Additional violations being discovered during the enforcement process
As such, it is important to understand that cases involving foreign nationals caught driving without a license often involve both criminal procedures and immigration enforcement at the same time.

2. Key Issues to Check During the Police Investigation Stage

After a foreign national is caught driving without a license, the first procedure they usually face is a police investigation.   This stage is more than a simple confirmation of facts—it is a crucial process that later becomes the basis for both criminal disposition and immigration review.   During the police investigation, the authorities typically examine the following matters:
  • Whether the individual was aware of the validity (or invalidity) of their license
  • Whether driving was unavoidable under the circumstances
  • Whether it was a one-time incident or involved repeated driving
  • Whether there was an accident and whether any additional violations occurred
Since the details organized during the police investigation may be recorded and directly forwarded to the immigration authorities, how the facts are organized and presented at this early stage can significantly affect the direction of any future relief measures.

3. What Standards Are Used to Review a Departure (Deportation) Order?

After being caught driving without a license, the issue that many foreign nationals fear the most is a departure order.   A departure order is a procedure separately carried out from criminal punishment. It is an administrative measure determined by the immigration authorities in order to maintain order in the management of immigration and stay status.   In making this decision, immigration authorities comprehensively consider factors such as:
  • The seriousness of the violation
  • Length of stay in Korea and the extent of settlement or ties in the country
  • Any prior history of legal violations
  • Likelihood of reoffending
In other words, a departure order is not automatically issued. It is determined based on an overall assessment of the individual’s circumstances and the severity of the violation. For this reason, even when criminal penalties are relatively minor, the immigration review may lead to a different outcome.

4. What Is the Basic Approach to Seeking Relief After Being Caught Driving Without a License?

After being caught driving without a license, the available relief measures for foreign nationals cannot be reduced to a single, simple solution.   What matters most is not viewing the criminal procedure and the immigration procedure separately, but understanding how they interact.   From the criminal-law perspective, key points include:
  • The circumstances of the violation and a detailed explanation
  • Demonstrating intent and concrete plans to prevent recurrence
From the immigration perspective, the following factors are central:
  • Stability of residence in Korea
  • Clarity of the purpose of stay
  • Whether the person is a long-term resident and the extent of their living base in Korea
In particular, for long-term foreign residents, it is important to prepare materials that clearly demonstrate whether the incident was a one-time mistake. Only when these facts are properly organized can one realistically review relief options aimed at reducing the likelihood of a departure order.   Driving without a license as a foreign national is a complex issue that may involve multiple stages, including:
  • Police investigation
  • Criminal procedure
  • Review for a departure order
Rather than taking the matter lightly and missing the appropriate timing to respond, it is crucial to calmly assess which stage you are currently in and organize what procedures are likely to follow.   At Law Firm Majung, we approach foreign national cases by reviewing the criminal process and immigration process together, rather than treating them as separate matters.       Multilingual consultation available in English and Chinese.   Professional interpreters assist from the first consultation to the conclusion of the case.   Offices in Seoul, Daejeon, Busan, Daegu, and Gwangju   Don’t face the legal system alone.
