Can a Foreign National Remain in Korea After Receiving a Departure Order?

If a foreign national receives a departure order from the Korean Immigration Office, is it mandatory to leave Korea within the designated period?   Also, if an objection or administrative lawsuit is filed after receiving the departure order, can the person continue to legally stay in Korea during the process?   Lastly, if the departure order is not followed, can the person be considered an illegal overstayer and face additional disadvantages such as fines or further immigration penalties?
  A. Answer

When a foreign national receives a departure order from the Immigration Office, it directly affects future stay status and potential immigration disadvantages.     Based on your question, we will explain the key points step by step.     First, the Basic Meaning of a Departure Order     A departure order is an administrative measure requiring a foreign national to voluntarily leave Korea within a specified period.     Therefore 👉 In principle, the person must depart within the designated period. 👉 Failure to comply may result in additional disadvantages.     Second, Legal Stay During Objections or Lawsuits     It is possible to file an objection or cancellation lawsuit against a departure order. However 👉 Simply filing a lawsuit 👉 Does NOT automatically guarantee a lawful stay in Korea.     In other words, ✔ Only if a stay of execution is granted ✔ Separate permission to remain is approved     can a lawful stay during the litigation period be recognized.     Third, Disadvantages of Failing to Comply with a Departure Order     If the departure order is not followed within the designated period     👉 The person may become an illegal overstayer due to exceeding the authorized stay period.       In such cases, possible disadvantages include ▪️ Administrative fines or penalty surcharges for overstaying ▪️ Longer future entry bans ▪️ Conversion to a forced deportation case     Fourth, What Is Important in Practice     At the departure order stage, the important issue is not simply “whether to leave Korea,” but also “how the case is handled strategically.”     For example ☑️ Explaining the necessity of remaining in Korea ☑️ Demonstrating social and living ties in Korea (family, employment, etc.) ☑️ Explaining the circumstances of the violation and efforts to prevent repetition     These factors may significantly affect the final result and the level of future immigration disadvantages.     A departure order for a foreign national is not merely a notice — it is an important administrative action directly connected to immigration status and future stay in Korea.   Even if a lawsuit is filed, a lawful stay is not automatically maintained unless additional legal measures are granted.   Furthermore, failing to comply with a departure order may lead to illegal overstay status, fines, and additional immigration disadvantages. For this reason, it is very important to establish the appropriate legal response strategy based on the specific circumstances of the case.
